XXXTentacion Is Facing Two Trials And Could Get Life In Prison

by HHL JT

Today, XXXTentacion got some seemingly good legal news.

The rapper and his lawyers presented an affidavit stating that the pregnant ex-girlfriend he's been accused of beating horribly is no longer cooperating with prosecutors and wants his charges of aggravated battery of a pregnant woman, domestic battery by strangulation, false imprisonment and witness-tampering dropped.

But not so fast. Prosecutors in Miami Dade County doubt XXX's ex actually signed the affidavit.  And even if she did, they plan to continue to pursue the charges.

Prosecutors also told Pitchfork they plan on having two trials, the first for the witness-tampering, and then one for all of the domestic violence charges.

"The case was reset for 12/15 for the State to sever the charges, creating two separate felony cases (one for the tampering with victim charge, and one for the original charges)," assistant state attorney Philip Harte said through a spokesperson. "Once the cases have severed, the State will proceed on the tampering with victim case first."

This is bad news for XXX, because the witness-tampering -- a first-degree felony -- is actually more serious than the domestic violence charges, which are all second and third-degree felonies. In fact, you can get life in prison in Florida for a first-degree felony conviction.

In sworn testimony in January, X's alleged victim said that the rapper threatened to hurt her if she testified. After that, he called and ended up offering her money not to testify. Both of which could be construed as witness-tampering.

XXX's lawyers have not commented on this development.
