Defense Lawyers Can't Use Tekashi 6ix9ine's Child Sex Case Against Him

When Tekashi 6ix9ine takes the stand as a government witness against  Aljermiah "Nuke" Mack and Anthony "Harv" Ellison in the coming weeks their lawyers won't be able to mention 6ix9ine's 2015 guilty plea for use of a child in sexual performance.

"[T]he Government respectfully requests that defense counsel be precluded from cross-examining CW-2 [6ix9ine] regarding...an October 21, 2015 conviction in New York County Supreme Court of Use of a Child Less Than 17 Years of Age in a Sexual Performance. The October 2015 Conviction is likely to cause a jury to unfairly discount CW-2’s testimony due to feelings of disgust concerning the underlying conduct. Cross-examination about this topic would be inappropriate because it would be substantially prejudicial, entirely nonprobative of any relevant issue, and irrelevant to testing the truthfulness of CW-2’s anticipated testimony."

Anthony and Ellison are accused of being involved in the notorious inside job robbery and kidnapping of 6ix9ine in July of last year.

A few months after that, Tekashi settled his child sex plea deal for good, getting an extra four years of probation.

In addition to forbidding Anthony and Ellison's lawyers from using that against 6ix9ine's credibility, the government will try to find jurors who don't have strong negative feelings about snitches.
